CITY OF SPRINGVILLE, ALABAMA NOTICE OF PROPOSED ACTION AT PUBLIC MEETING

Notice is hereby given that on March 5, 2018 at 6:00 P.M., Central Time (or at such other time as such meeting may be adjourned and reconvened), at the Springville City Hall at 160 Walker Drive; Springville, AL 35146, the City Council of the City of Springville, Alabama (the “City”) will hold a meeting, which will constitute a public meeting, to consider, discuss, vote upon, and take other action authorizing and approving a Project Development Agreement between the City, St. Clair County, Alabama (the “County”) and Don Huey (“Huey”), under which Huey will transfer real property (the “Property”) within the corporate limits of the City to the Alabama Trust Fund for the State of Alabama (the “ALT”) to be used as a Forever Wild Recreation Area and Nature Preserve (a “Forever Wild Park”) and the City will assist in the form of a one-time payment of $100,000 to Trustmark Bank (the lender which has provided him the loan for the purchase of the Property) for the benefit of Huey for the purpose of promoting the economic / commercial development of the City. The City will take public comment at the aforementioned meeting.

The City believes that the Forever Wild Park together with the provision of its assistance will have at least the following public benefits: enhancing the public benefit and welfare of the citizens of the City; creating jobs for residents of the City; increasing the tax revenues in and around the City; promoting the location, relocation, expansion and retention of commercial enterprises in the City inuring to the economic health of the City, and; improving the quality of life for citizens in and around the City. Further, the City will seek to determine at the public meeting whether the expenditure of public funds as described in this notice serves a valid and sufficient public purpose, notwithstanding any incidental benefit accruing to any private individual, entity or entities.

A draft of the Development Agreement may be inspected at the office of the City Clerk at the Springville City Hall at 160 Walker Drive; Springville, AL 35146, during regular business hours prior to the scheduled meeting. All members of the public are invited to attend the meeting. The public hearing will provide an opportunity for all interested members of the public to submit comments. Those unable to attend are encouraged to submit their written opinions to the City Clerk prior to the scheduled meeting.

Notice of this public meeting is being published pursuant to the requirements of Section 94.01 of the Constitution of Alabama of 1901 (also known as Amendment 772 to the Alabama Constitution of 1901), as amended, and all other applicable laws, to the extent applicable.
