DARRELL FIXX, KATHLEEN PHILLIPS and WILLIAM WHITE TRUSTEES OF THE MONTGOMERY PRESBYTERIAN CHURCH, AND THE UNKNOWN MEMBERS OF THE CONGREGATION OF THE MONTGOMERY PRESBYTERIAN CHURCH, RESPONDENTS. NOTICE OF PROPOSED CONVEYANCE TAKE NOTICE that the Presbytery of West Virginia, for and on behalf of the Presbyterian Church (U.S.A.), on or after the date of the final publication of this Notice as a Class II legal publication pursuant to West Virginia Code c35-1-10, and in accordance with West Virginia Code c59-3-1 et seq,, shall grant, sell and convey the following real estate with the improvements situate thereon, to Wesley Eugene Hill and Brenda McShawn Hill for the sum of $70,000.00 and which real estate is more particularly described as follows: That certain tract or parcel of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in the City of Montgomery, Fayette County, West Virginia, and being more particularly described as follows, to-wit; "Beginning on Fourth Avenue at a point corner to the Presbyterian Church lot, thence westwardly with said Fourth Avenue 70 feet to a point on said Avenue and corner to the lot of Betty Davin; thence westwardly with the line said Betty Davin ninety-four (94) feet to a point on an alley and corner with said Davin lot; thence with said alley in an easterly direction and at right angles with last said line seventy (70) feet to appoint on said alley corner to the Presbyterian Church lot, thence southwardly with the line of said Presbyterian church lot ninety-four (94) fee to the beginning; the same being all of lot #19, and three-fourths (3/4) of the lot #19 in Block 16 as shown on the map of the City of Montgomery as prepared by I. J. Settle and of record in the Office of the Clerk of the County Court, Fayette County, West Virginia. And being the same real estate which was conveyed unto F. H. Montgomery, D. G. Smallridge, J. S. McKeever, C. P. Dent and S. J. Champe, the Trustees of the Montgomery Presbyterian Church, by deed of Julia r. Montgomery and Julia R. Montgomery, Administratrix, dated April 11, 1938, and recorded in the aforesaid Clerk's Office in Deed Book 88, at Page 360. The Montgomery Presbyterian Church was dissolved on or about May 17, 2017, at which time title to said real estate vested in the Presbytery of West Virginia, for an on behalf of the Presbyterian Church (U.S.A.). NOTICE is further given that the Respondents or any other interested persons may attend the hearing scheduled before the Honorable John W. Hatcher, Jr., Judge of the Circuit Court of Fayette County, West Virginia, on the 15th day of March, 2018, at 2:30 o'clock p.m. in the Courtroom located on the second floor of the Fayette County Courthouse, Fayetteville, West Virginia, at which time the Petitioners shall seek approval of the said sale of the aforesaid real estate and disposition of the proceeds derived therefrom.
