Pursuant to Section 21.016(d)(3), Texas Property Code, the Special Commissioners hereby issue this Notice of Hearing.

NOTICE IS HEREBY GIVEN TO:

THE UNKNOWN HEIRS OF ELMER DEE HAIRGROVE, THE UNKNOWN HEIRS OF REBA HAIRGROVE, THE UNKNOWN HEIRS OF CHARLES LOUIS HAIRGROVE, and THE UNKNOWN HEIRS OF BILLY RAY HAIRGROVE.

NOTICE BY PUBLICATION OF SPECIAL COMMISSIONERS’ HEARING

Pursuant to Section 21.016(d)(3), Texas Property Code, the Special Commission hereby issue this Notice of Hearing.

NOTION IS HEREBY GIVEN TO:

THE UNKNOWN HEIRS OF ELMER DEE HAIRGROVE,

THE UNKNOWN HEIRS OF REBA HAIRGROVE,

THE UNKNOWN HEIRS OF CHARLES LOUIS HAIRGROVE, and

THE UNKNOWN HEIRS OF BILLY RAY HAIRGROVE.

Pursuant to Section 21.016(d)(3), Texas Property Code, you and each of you are hereby notified that on the 10:00 o'clock A.M. on the 14th day of November, 2017, at the Henderson County Courthouse, 100 East Tyler, Athens, Texas 75751, in Room 102, the undersigned Special Commissioners appointed by the Judge of the County Court at Law Number Two of Henderson County, Texas, will convene a hearing to assess the damages caused by the condemnation of an interest in the hereinafter described property. Such hearing date is later than the Monday following the expiration of 42 days from the date of issuance of this Notice.

This is a condemnation proceeding styled: TARRANT REGIONAL WATER DISTRICT, A WATER CONTROL AND IMPROVEMENT DISTRICT, v. FREDERICK L. WILLIAMS; DONNA JO WILLIAMS; HERITAGE LAND BANK, FLCA; UNKNOWN HEIRS OF ELMER DEE HAIRGROVE; UNKNOWN HEIRS OF REBA HAIRGROVE; WALTER EUGENE HAIRGROVE; BOBBY JOE HAIRGROVE; SENA PETERSEN HAIRGROVE; ELMER DEE HAIRGROVE, JR.; JACKIE HAIRGROVE SORRELLS; UNKNOWN HEIRS OF CHARLES LOUIS HAIRGROVE; TONYA LYNNE HUBACEK; UNKNOWN HEIRS OF BILLY RAY HAIRGROVE; ANITA HAIRGROVE; NANCY DEANN HAIRGROVE; HEATHER LYNN BOOTH; DOUGLAS WADE HAIRGROVE; AND TODD ALAN HAIRGROVE, as stated in the Petition for Condemnation filed on August 16, 2017 with the Judge of the County Court at Law No. 2 of Henderson County, Texas, and which was assigned No. 00207-CCL2-17. Said Judge having appointed the undersigned as special commissioners to assess the damages of the owner of the property being condemned, the undersigned will proceed to hear said matters and to act thereon in the manner directed by law.
In this condemnation proceeding, Tarrant Regional Water District, a Water Control and Improvement District, seeks to acquire an easement, under the rights and terms stated in the Petition for Condemnation and the Water Pipeline(s) Easement and Right of Way attached thereto, in and across real property to which the THE UNKNOWN HEIRS OF ELMER DEE HAIRGROVE, THE UNKNOWN HEIRS OF REBA HAIRGROVE, THE UNKNOWN HEIRS OF CHARLES LOUIS HAIRGROVE, THE UNKNOWN HEIRS OF BILLY RAY HAIRGROVE, and the other named condemnees claim or may claim an interest.
The property on which the easement interest is being condemned is described as follows: Being a 9.090 acre (395,962 square feet) tract of land situated in the Philip Jackson Survey, Abstract Number 392, Henderson County, Texas and more particularly that certain 116.256 acre tract conveyed to Frederick L. Williams and Donna Jo Williams by instrument recorded in Volume 1994, Page 354, Official Public Records, Henderson County, Texas, and as is more particularly described in the Petition For Condemnation.
The preceding Notice to be served by publication has been approved, issued, and signed the 26th day of September, 2017.
