NOTICE OF MORTGAGE

FORECLOSURE SALE



Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by William J. Burchfiel, an unmarried man, to Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, Platinum Mortgage, Inc., and Lender's successors and assigns), dated the 21st day of July, 2008, which Mortgage was recorded in the Office of the Judge of Probate of Limestone County, Alabama, in Real Property Book 2008, at Page 45161; said Mortgage having been transferred and assigned by Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, Platinum Mortgage, Inc., and Lender's successors and assigns) to Alabama Housing Finance Authority by virtue of that certain Assignment of Mortgage dated February 28, 2017, and recorded in said Probate Office in Real Property Book 2017, at Page 14786. The undersigned, Alabama Housing Finance Authority, as Assignee of said Mortgage will, under and by virtue of the power of sale contained in said Mortgage, sell at auction to the highest bidder for cash before the main entrance of the Limestone County Courthouse in the City of Athens, Alabama, during the legal hours of sale on May 31, 2017, the real property described in said Mortgage, which said description is hereby referred to and made a part hereof, said property being situated in Limestone County, Alabama, to-wit:


Commence at the Northwest corner of the Northeast Quarter of the Northwest Quarter of Section 22, Township 3 South, Range 6 West, Limestone County, Alabama, thence South 87 degrees 52 minutes 44 seconds East a distance of 119.35 feet to a point in Snake Road, thence South 88 degrees 55 minutes 59 seconds East a distance of 1238.05 feet to a point at the intersection of Snake Road and Ripley Road, thence South 05 degrees 00 minutes 35 seconds West a distance of 500.56 feet to a point in Ripley Road, thence South 00 degrees 02 minutes 52 seconds West a distance of 164.47 feet to a point in said Ripley Road, thence South 19 degrees 29 minutes 27 seconds East a distance of 163.27 feet to an existing railroad spike in said Ripley Road, thence South 32 degrees 28 minutes 18 seconds East a distance of 164.70 feet to an existing railroad spike in said Ripley Road, thence South 37 degrees 54 minutes 21 seconds East a distance of 115.98 feet to a set railroad spike in said Ripley Road, said railroad spike being the Point of True Beginning of the tract herein described,



Thence from the Point of True Beginning continue South 37 degrees 54 minutes 21 seconds East a distance of 48.70 feet to an existing railroad spike in said Ripley Road,



Thence South 39 degrees 13 minutes 52 seconds East a distance of 151.50 feet to a set railroad spike in said Ripley Road, said railroad spike also being North 39 degrees 13 minutes 52 seconds West a distance of 32.50 feet from an existing railroad spike,



Thence South 85 degrees 22 minutes 08 seconds West a distance of 285.00 feet to a set 5/8” rebar with cap stamped “Dunivant Engr. Co. CA-0044-LS”, passing a set 5/8” rebar with cap stamped “Dunivant Engr. Co. CA-0044-LS”, being a reference corner, at a distance of 36.45 feet,



Thence North 12 degrees 55 minutes 24 seconds West a distance of 102.18 feet to a set 5/8” rebar with cap stamped “Dunivant Engr. Co. CA-0044-LS”,



Thence North 66 degrees 23 minutes 21 seconds East a distance of 197.74 feet to the Point of True Beginning, passing a set 5/8” rebar with cap stamped “Dunivant Engr. Co. CA-0044-LS”, being a reference corner, at a distance of 166.78 feet, and containing 0.77 acres, more or less.



See that certain Partial Release dated October 28, 2013, and recorded in Real Property Book 2013, at Page 69148 in the Office of the Judge of Probate of Limestone County, Alabama.



Less and except that certain easement described in that certain Partial Release dated April 25, 2013 and recorded in Real Property Book 2013, at Page 29914 in the Office of the Judge of Probate of Limestone County, Alabama, and more particularly described as follows:



A 10 foot wide Permanent Utility Easement and an accompanying 15 foot temporary construction easement crossing a parcel of land located in the Northeast Quarter of the Northwest Quarter of Section 22, Township 3 South, Range 6 West of Limestone County, Alabama and being more particularly described below.



Said easement crosses a parcel of land owned by William J. Burchfiel as recorded in Deed Book 2012, Page 67650 of the Probate Judge's Office of Limestone County, Alabama as specified for Parcel 44-12-05-22-0-000-006.008 by the Property Ownership Maps as prepared under the direction of the State of Alabama Department of Revenue.



Said Permanent Utility Easement shall commence at a point, said point being on the northern boundary of said Parcel 6.008 approximately 32+' west of the centerline of Ripley Road, thence in a southeasterly direction 95+' and parallel to the 5+' west of an existing barbed wire fence to a point lying on the southern fence line, said point being approximately 36+' west of the centerline of Ripley Road, thence in a southeasterly direction 62+' to a point on the easterly boundary of said parcel, said point being 44+' northwest of the southeastern corner of said parcel.



This line shall form the centerline of a 10 foot Permanent Utility Easement with a 15 foot Temporary Construction Easement along and adjacent to the west side of the Permanent Utility Easement. Said Temporary Construction Easement will be abandoned upon completion of construction.
