FORECLOSURE NOTICE

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by JAMES RHOTEN III AND JESSICA A. RHOTEN, HUSBAND AND WIFE , to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC AS NOMINEE FOR FIRST LIBERTY FINANCIAL GROUP LLC., on the 21st day of August, 2015, said mortgage recorded in the Office of the Judge of Probate of St. Clair County, Alabama, on August 27, 2015, in Deed/Mortgage Book 2015, Page 26639, St. Clair County, Alabama Records, said Mortgage having subsequently been transferred and assigned to Pacific Union Financial, LLC, by instrument recorded in the aforesaid Probate Office; notice is hereby given that the undersigned Pacific Union Financial, LLC, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse in Pell City, St. Clair County, Alabama, on December 6, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in St. Clair County, Alabama, to-wit:

LOT 9, ACCORDING TO THE MAP AND SURVEY OF THE TERRACE AT WOODLAND RIDGE ESTATES, PHASE 10, FIRST SECTOR, AS RECORDED IN MAP BOOK 2004, PAGE 83, IN THE OFFICE OF THE JUDGE OF PROBATE OF ST CLAIR COUNTY, ALABAMA.

Said legal description being controlling, however the property is more commonly known as 7315 OLD ACTON RD, ODENVILLE, AL 35120.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
