NOTICE

OFFICIAL NOTICE OF

PUBLIC HEARING TO

CONSIDER APPLICATION TO

VACATE A PORTION

OF CULLMAN COUNTY

ROAD 1601.



WHEREAS, the Industrial Development Board of the City of Cullman, desires to vacate a portion of a county road within the County limits of Cullman, pursuant to Ala. Code § 23-4-20 (1975), more particularly described as follows:



A part of the Revised Lot 3A of the Resurvey of the Resurvey of Lot 3, Preliminary Plat, City of Cullman, Industrial Park No.5 as recorded in Cabinet 2009, Slide 7 in the Office of the Judge of Probate, containing 0.18 acres ofland, more or less, and being more particularly described as follows:



Commence at the Southwest comer of said Revised Lot 3A and run 'North 86 degrees 21 minutes 53 seconds East and run along the South line of said Lot 3A a distance of 132.37 feet to the point of beginning; thence continue North 86 degrees 21 minutes 53 seconds East a distance of 6.29 fee to a turning point in the south line of said Lot 3A; thence North 71 degrees 07 minutes 40 seconds East continuing along a South line of Lot 10 a distance of 46.45 fee to a point; thence North 00 degrees 48 minutes 25 seconds East a distance of 0.82 feet to the point of curvature of a curve to the left having central angle of 299 degrees 53 minutes 21 seconds a radius of50.00 feet and a chord bearing of South 87 degrees 29 minutes 43 seconds West; thence run along the arc of said curve an arc distance of 26l.70 feet; thence South 00 degrees 48 minutes 25 seconds West a distance of 14.05 feet to the point of beginning;



WHEREAS, pursuant to Ala. Code § 23-4-2 (1975), the Cullman County Commission is required to hold a public hearing, prior to taking final action;



WHEREAS, notice of which is required by statute, shall occur once a week for four (4) consecutive weeks;



WHEREAS, a public hearing will take place on Tuesday, November 14,2017, at 10:00 a.m., at the Cullman County Commission Meeting Room; First Floor; Cullman County

Courthouse; 500 2nd Avenue, S.W. Cullman, Alabama 35055;



WHEREAS, applicant, the Industrial Development Board of the City of Cullman, is requesting vacation of the above-described portion of Cullman County Road 1601.



WHEREAS, an action is requested for an adoption and approval of a Resolution vacating the above-described portion of Cullman County Road 1601.



WHEREAS, said notice is posted in accordance with Title 23-4-2, et.seq. Code of Alabama, 1975. All persons who desire shall have an opportunity of being heard in opposition to or in favor of such resolution. This public notice is posted a minimum of thirty (30) days prior to the date of the public hearing at: Cullman County Courthouse Entrance Bulletin Board.



NOTICE IS HEREBY GIVEN that the provision of the Resolution vacating a portion of Cullman County Road 1601 , will be considered by the Cullman County Commission at a Public Hearing to be held on Tuesday, November 14, 2017, at the Cullman County Commission Meeting Room at 10:00 a.m. at which time and place all persons who desire shall have an opportunity of being heard in opposition to or in favor of such Resolution or any provision thereof.
