MORTGAGE

FORECLOSURE NOTICE



WHEREAS, on the 31st day of December, 2001, Paulette Gourley and David Gourley, married persons, did execute and deliver to Merchants Bank a mortgage on real estate hereinafter described, which mortgage appears of record in the Office of the Judge of Probate of Cullman County, Alabama, in Book 1224, Page 630.



WHEREAS, default has been made in the payment of said mortgage in favor of Merchants Bank, provided therein, which default continues at this date, and said mortgage is subject to foreclosure.



NOW, THEREFORE, three weeks notice is hereby given that the undersigned will sell at public outcry to the highest bidder for cash, at the front door of the Cullman County Courthouse, Cullman, Alabama, within the legal hours of sale, to-wit: Eleven O'clock A.M. to Four O’clock PM, on the 9th day, of February, 2018, the real estate mortgaged by the mortgage, being more particularly described as lying and being situated in the County of Cullman, State of Alabama, to-wit:



A tract of land situated in the SW Quarter of the NE Quarter and partially in the SE Quarter of the NW Quarter of Section 33, Township 10 South, Range 2 West, Cullman County, Alabama, said tract being more particularly described as follows: Commence at the NW corner of the SE Quarter of the NW Quarter of Section 33, Township 10 South, Range 2 West, Cullman County, Alabama, and run thence North 90 degrees 00'00" East along the North line of said Quarter-Quarter Section for a distance of 285.41 feet, thence run South 70 degrees 45'00" East for a distance of 1112.79 feet to an iron pin set, said point being the point of beginning of the tract herein described, thence continue along last stated course a distance of 420.0 feet to an iron pin set, thence run South 19 degrees 15'00" West for a distance of 210.0 feet to an iron pin set, thence run North 70 degrees 45'00" West for a distance of 420.0 feet to an iron pin set, thence run North 19 degrees 15'00" West for a distance of 210.0 feet back to the point of beginning. Said tract containing 2.02 acres, more or less.



Right of way for ingress and egress, lying and being across the existing gravel drive, and more particularly described as being situated in the SE quarter of the NW quarter of Section 33, Township 10 South Range 2 West and running from the West property line of a 2.02 acre tract now owned by grantee, with said ROW being more particularly described as follows: Commence at the NW corner of the SE quarter of the NW quarter of Section 33, Township 10 South, Range 2 West, Cullman County, Alabama and run thence North 90 degrees 0'00" East along the North line of said 40, 285.41 feet, thence run South 70 degrees 45'0" East 1112.79 feet to an iron pin set, thence South 19 degrees 15'0" W 70 feet, more or less, to the center of existing gravel drive, thence northwesterly along said gravel drive to it’s intersection with public road, with property lying 15 feet on either side of the centerline of described right of way.



This sale and conveyance will be made subject to any existing federal tax liens, if any, and/or special assessments, if any, which might adversely affect the title to subject property.



Said sale will be made subject to the right of redemption of the parties and for the purpose of foreclosing the mortgage, paying the costs thereof and a reasonable attorney's fee.
